Man fined for assault on doctor - 20/10/2004

A man was ordered to pay a Lm500 fine for assaulting a nurse and slightly injuring Dr Jonathan Joslyn at St Luke’s Hospital on 17 March 2002. The incident occurred when Brian Tabone, a man who died after being stabbed during a fight in Paceville, was taken to hospital.

Francis Farrugia, 43, from Bikirkara attacked the doctor as Mr Tabone, who was in critical condition, was being carried out of the ambulance on a stretcher. Mr Tabone was the partner of Farrugia’s daughter. Farrugia was also guilty of assaulting Christopher Borg, a nurse who was assisting the doctor. Mr Tabone died as the incident in question occurred.

The court considered that the partner of Farrugia’s daughter had just passed away as he assaulted the doctor and the nurse. It was obvious that he was agitated and emotional and even got hurt himself. For these reasons the court, presided over by Magistrate Consuelo Scerri Herrera, felt a prison sentence would not be adequate in these circumstances.

Farrugia was fined Lm500 and ordered not to assault or injure Dr Joslyn and Christopher Borg for the next year.
